Relief from Removal

There are many numerous reasons why someone can end up having to deal with removal proceedings. It is not only an extremely complex area of immigration law but also a difficult one to tame. When one has been brought to appear at the Executive Office of Immigration Review or immigration court, he/she is considered to be in removal proceedings. This person is called a Respondent. The document which summons the Respondent to court lists the allegations made against the Respondent as well as the list of charges the Respondent is being accused of, commonly called the “Notice to Appear.”

Due to “in absentia” order, when a respondent does not show up, his or her court hearing will be removed from the United States due to his/her absence. It is crucial for respondents to appear at their hearing when they are requested to appear due to Notice to Appear or Notice of hearing. Moreover, the Respondent should always keep the court and the DHS on notice of any address change in order to receive all information pertinent to appearances in court and other court correspondence.

The outcome of many removal proceedings depends on whether the individual is eligible for relief from removal. Immigration law provides relief from removal to individuals who meet specific criteria. In most removal proceedings, individuals admit that they are removable, but then apply for one or more forms of relief. In such cases, individuals must prove that they are eligible for relief.

The most common forms of relief are:

  • Cancellation of removal

  • Adjustment of status

  • Asylum

  • Withholding of removal or deportation

  • Suspension of deportation

  • Waivers of deportability & inadmissibility

  • Voluntary Departure

  • Prosecutorial Discretion/Administrative Closure
